Summary of Facts

The films of the incident were shown and Mr Goodwin pointed out that Jockey Shaun McKay struck his mount 7 times prior to the 100 metre mark.  This was confirmed by Mr McKay. He had no comment to make.

Reason for Decision

As the charge was admitted and the Rule was clearly breached, it was deemed proved.

Submissions for Penalty

Mr Goodwin informed the Adjudicative Committee that this was Mr McKay’s third breach of this Rule. His others being on 11/6/21, 13/10/21 and 22/1/22.He was also fined $250 at the last breach. Mr Goodwin asked for a period of suspension to be imposed.

Reason for Penalty

As this was Mr McKay’s 4th breach of the Rule a period of suspension must be imposed. It was pointed out to Mr McKay that as a Senior Jockey he has a responsibility to ensure he rides within the Rules. It was not deemed appropriate to impose a fine in conjunction with a suspension.

Conclusion

Mr McKay was suspended from race riding for a period of 6 days beginning after racing on 2/3/22 and ending after completion of racing on 11/3/22.
