Summary of Facts:

Mr Oatham alleged that Mr Mudhoo weighed in 0.7 kg lighter than he weighed out for BAILADOR in Race 8.

Mr Oatham stated that Mr Mudhoo had weighed in at 58.8 instead of 59.5. The lead was missing from the lead bag.

Mr Mudhoo, the Rider of BAILADOR, acknowledged it was his error. He said he weighed out with the lead in one hand and the bag in the other and he had then been distracted and had forgotten to add the lead to the bag.

Decision:

As Mr Mudhoo has admitted the breach, it is found to be proved.

Submissions as to Penalty:

Mr Oatham produced the Respondent’s record under this Rule. It was clear. He submitted a fine in the $200 to $300 range was appropriate. Mr Mudhoo was apologetic and emphasised it was accidental.

Reasons for Penalty:

This was a serious error by Mr Mudhoo and is one that could have had more serious consequences had the horse finished in a dividend bearing position. Previous breaches of this Rule where the horse was unplaced have resulted in fines in the range of $200 to $300.

Conclusion:

Mr Mudhoo is fined $250 and is reminded of his professional obligations.
