Penalty: Apprentice Jockey Rohan Mudhoo is fined $300

EVIDENCE:

Stewards charged Mr Rohan Mudhoo with excessive use of the whip prior to the 100 metres when riding out TAKE THE DEEL in Race 9. Mr Mudhoo admitted the breach and was assisted at the hearing by Mr David Walsh.

SUBMISSIONS:

Mr Davidson stated that TAKE THE DEEL was placed near the back of the field when entering the home straight. Mr Mudhoo angled his mount outwards to gain clear room. He then used his whip eight times prior to the 100 metres. They were not consecutive strikes but the number was excessive and in breach of the Rule.

Mr Walsh stated that TAKE THE DEEL was lugging inwards and Mr Mudhoo had used the stick in his left hand. The horse was responding and was making ground on the leader at the finish. He had erred on the number of strikes with the whip. Mr Mudhoo added that he was very focused on giving his horse every chance in the race.

REASON FOR DECISION:

Mr Mudhoo admitted the breach and it is found proved.

SUBMISSION FOR PENALTY:

Mr Davidson submitted that Mr Mudhoo had a clear whip record over the previous 12 months and he was eligible for a fine for a first offence. The race was not a listed race and he sought the first offence penalty of $300.

Mr Mudhoo accepted the submissions of the Stewards in regards to penalty.

REASON FOR PENALTY:

Mr Mudhoo has a very good record and while the strikes with the whip prior to the 100 metres were excessive in number, they were not continuous. The recommended fine sought by the Stewards is appropriate.

CONCLUSIONS:

Mr Mudhoo is fined $300.
