BACKGROUND
Following the conclusion of Race 5 , Bupa Care Services Francolin Stakes, an Information was lodged by Stipendiary Steward, Mr Mark Davidson alleging that AMBERECHO trained by John and Karen Parsons was represented in the incorrect gear.
Mr Davidson said the horse raced in 2 cups rather than 1 cup bunker.
DECISION
As the charge was admitted it is deemed proved.
John and Karen Parsons did not wish to be present at the hearing.
SUBMISSIONS ON PENALTY
Mr Davidson stated that this was the fourth offence within a year regarding incorrect gear not being notified.
On the 9/4/2022 $50 fine, 14/9/2022 $50 fine, 16/3/2023 $100 fine.
Mr Davidson believed there needed to be an uplift in fine due to the continuing offences . He left it up to the Adjudicative Committee to decide.
CONCLUSION
The Adjudicative Committee agreed with Mr Davidson that an uplift was necessary due to this being the fourth offence and a penalty of $150 is opposed.
