BACKGROUND
Following the running of Race 3, D T King Transport Aparima Handicap, the Respondent, Kin Kwo admitted a breach of Rule 638(3)(g)(i) in that , as the Rider of SCARED KITTY he struck his mount 7 times prior to the 100 metres.
Rule 638(3) provides:-
(g) Subject to other requirements this rule 638(3), in a flat Race or trial (including jump outs and/or tests for certification purposes), a Rider must not:
(i) strike a horse with a whip more than 5 times prior to the 100 metre mark (other than a slapping motion down the shoulder with the whip hand remaining on the reins.
EVIDENCE
Stipendiary Steward, Mr Mark Davidson asked Stipendiary Steward, Miss Rebecca Hayley to show a replay of the final 350 metres of the Race.
She pointed out SACARED KITTY turning into the home straight when Mr Kwo commenced using his whip shortly thereafter, and used it on a total of 7 occasions to the 100 metres.
DECISION
The charge is admitted and is therefore deemed proved.
SUBMISSIONS FOR PENALTY
Mr Davidson said that the Respondent had no previous breach on his record .
The penalty guide starting point for a first breach is a fine of $250.
Mr Davidson stated that there were no aggravating or mitigating circumstances.
The Respondent said he simply made an error of judgement with the long straight and lost count.
REASONS FOR PENALTY
Under the RIB Thoroughbred Racing Penalty Guide (February 2023), the starting point for penalty for this breach is a fine of $250 .
The Respondent’s outstanding record was noted .
CONCLUSION
The Respondent, Jockey Kin Kwo is fined $250.
