Penalty: Jockey Tina Comignaghi is suspended for 4 days

Background:

Mr Davidson alleged that in Race 2, Ms Comignaghi allowed her mount POWERLITE to shift inwards when not clear of NAKAMOTO which was crowded and checked near the 250 metres.

Ms Algar demonstrated on the videos that near the top of the home straight the Respondent allowed her mount to shift inwards looking for a run when not her length and another clear of the runner to her inside. The video demonstrated there was contact with NAKAMOTO.

Ms Comignaghi said she was desperate for a run and saw a gap and went for it. NAKAMOTO was not stopping as quickly as she thought it was. It was just bad timing.

Decision:

As Ms Comignaghi has admitted the breach, it is found to be proved.

Submissions as to Penalty:

Mr Davidson produced the Respondent’s record which showed only one breach of the Careless Riding Rule in the past 12 months. He described this as an outstanding record for a busy Rider. He assessed the breach as low to mid-range. Ms Comignaghi stated she wanted a deferment until after racing at Timaru.

Reasons for Penalty:

The Adjudicative Committee believes the breach is correctly assessed by Mr Davidson as being low to mid-range. Ms Comignaghi has taken a gap that looked to have briefly appeared and has tried to straighten her mount once it became tight, but she is too late to avoid contact. After credit for Ms Comignaghi’s excellent record and her admission of the breach, from a starting point of 5 to 6 days, the penalty is a 4-day suspension.

Conclusion:

Ms Comignaghi is suspended from the end of racing on 7 October up to and including 13 October 2022.
