BACKGROUND:
Following the running of Race 8, Daphne Bannan Memorial Rating 65, the Respondent, Jockey Tegan Newman, admitted a breach of Rule 638(3)(g)(i) in that, as the rider of ROYCE ROCA in the race, she struck her mount 6 times prior to the 100 metres.
Rule 638(3) provides:
(g) Â Â Â Subject to the other requirements this Rule 638(3), in a Flat Race or trial (including jump-outs and/or tests for certification purposes), a Rider must not:
 (i)  strike a horse with a whip more than 5 times prior to the 100-metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins.
EVIDENCE:
Stipendiary Steward, Mark Davidson, showed a video replay of the final 300 metres of the race. He pointed out ROYCE ROCA in the lead as the field turned into the home straight. He showed that she commenced using her whip shortly thereafter, and used it on a total of 6 occasions to the 100 metres. The Respondent went on to win the race.
DECISION:
The charge is admitted and is therefore deemed proved.
SUBMISSIONS FOR PENALTY:
Mr Davidson said that the Respondent has one previous breach on her record – a warning on 14 December 2022 at Ruakaka for 6 strikes prior to the 100 metres. The Penalty Guide starting point for a 2nd breach is a fine of $250. He left it to the Adjudicative Committee to decide whether a small uplift was required for the fact that the Respondent won the race. He conceded that the strikes were well spaced.
REASONS FOR PENALTY:
Under the RIB Thoroughbred Racing Penalty Guide (February 2023), the starting point for penalty for this breach is a fine of $250. The Adjudicative Committee did not regard the fact that the Respondent won the race as an aggravating factor in this case. The strikes were well spaced, and not forceful. Furthermore, the Respondent’s use of the whip in the final 100 metres of the race was minimal. The Adjudicative Committee did not believe any advantage had been gained.
CONCLUSION:
The Respondent, Jockey Tegan Newman, is fined $250.
