Penalty: Apprentice Jockey Lemmy Douglas is suspended for 5 days

EVIDENCE:

Following the running of Race 1, an Information was presented by Stipendiary Steward Ms Veronica Algar alleging a breach of Rule 638(3)(g)(i) by Apprentice Jockey Mr Lemmy Douglas.

Mr Douglas confirmed he was conversant with the Rule, he understood the Charge and he admitted the breach. Mr Douglas was assisted at the hearing by Apprentice Mentor Mr David Walsh.

Ms Algar showed the video replays of the final straight with Mr Douglas widest on the track. Ms Algar counted 7 strikes which Mr Douglas agreed was correct.

DECISION:

The Respondent having admitted the breach, the charge was deemed to be proved.

SUBMISSIONS FOR PENALTY:

Ms Algar stated Mr Douglas had two previous breaches of the Rule.

The first a warning at Auckland for 6 strikes prior to the 100m.

The second at Riccarton on the 22nd April 2023 where he was fined $250 for 6 strikes prior to the 100m.

Ms Algar alluded to the Thoroughbred Racing Penalty Guide which has a 5 day suspension indicated for a third breach with 2 additional strikes.

Mr Douglas made no submissions on Penalty but asked to defer any suspension until after 25 May 2023, so he may fulfill engagements.

Mr Walsh said using a whip is relatively new to Mr Douglas, but he will have to come to terms with the Rule or it will become very expensive.

REASONS FOR PENALTY:

The Penalty Guide provides a 5 day suspension for a third breach with 2 additional strikes and the Adjudicative Committee sees no reason to depart from the Guidelines in the circumstances of this case.

CONCLUSION:

Apprentice Jockey Mr Lemmy Douglas is suspended from the conclusion of racing on the 25 May 2023, up to and including racing on the 2 June 2023.
