EVIDENCE

Following the running of Race No 8, the James Bull Holdings Rangitikei Gold Cup, Mr Davidson presented an Information charging Ms Lazet with a breach of the excessive whip Rule 638(3)(g)(i). He contended that Ms Lazet the Rider of “VERRY FLASH” used her whip prior to the 100-metre mark in the excess of 5 occasions permitted under the Rules.

Ms Lazet assisted by Ms Clapperton, admitted the breach.

The Race films illustrated that, when finishing fast from a position towards the rear at the 250 metre mark, Ms Lazet struck the mount 7 times prior to the 100-metre mark “VERRY FLASH” won the race and a stake of $34,500 in this Listed race.

DECISION

As the breach was admitted it is found proved.

SUBMISSIONS ON PENALTY

Mr Davison advised that Ms Lazet had a genuinely good record, although was warned in March 2022, for applying one strike over the limit. He referred to the Guideline for black type races being a starting point fine of 50% of the Jockey’s share of the stake earned by the mount, but referred to the fact that Ms Lazet was an Apprentice Rider, and that whatever she “earned” is ultimately halved with her employer

REASONS FOR PENALTY

We adopt a starting point of $800 (the actual percentage of the Jockey’s share of the winning stake was $862). There are mitigating features which justify a meaningful discount. Ms Lazet’s employer will be entitled to receive 50% of her winning percentage, she would, without any fine, have retained $431.  A fine of $400 imposed upon her leaves her with $31.  She is young Apprentice with limited financial resources.

PENALTY

In our Judgement a fine of $400 is appropriate to meet the circumstances of this breach.
