Rangiora HRC 25 August 2024 – R11 – Ricky Alfeld

EVIDENCE:

Following the running of Race 11, Stipendiary Steward Mr Matt Sole presented an Information alleging a breach of Rule 869(2) by Driver Richard Alfeld in that he “used his whip with more than a wrist flicking motion”.

Mr Alfeld stated he understood the Rule and the Charge and confirmed he admitted the breach.

The race videos were used to identify Mr Alfeld (HIT THE BEACH) finishing down the inside of the track where Stewards alleged, he has used his whip on many occasions that were well outside of the Guidelines. He said Mr Alfeld has returned to a compliant style over the last 50m of the race.

Mr Alfeld had nothing to add to Mr Sole’s assessment.

DECISION:

As the charge was admitted, it was deemed proved.

SUBMISSIONS FOR PENALTY:

Mr Sole stated Mr Alfeld has had 872 lifetime drives and his record is clear. He said this breach is at mid-level and would leave it to the Adjudicative Committee to find a suitable penalty.

Mr Alfeld made no submissions, but said he would prefer a suspension rather than a fine.

REASONS FOR PENALTY:

The Penalty Guidelines provide for a first breach at mid-level, which this is, a 2-day suspension or a $500 fine.

The Adjudicative Committee could see no factors to depart from the Penalty Guidelines in the circumstances of this case.

CONCLUSION:

Driver Richard Alfeld is suspended for 2 days, from the conclusion of racing today, up to and including racing on 1 September 2024.
