SUMMARY OF FACTS:

Following the running of Race 5 Stipendiary Steward, Mr Shane Renault presented an Information alleging a breach of Rule 857(7)(a) by Junior Driver Mr Tom Bamford which was admitted. Mr Bamford stated he was conversant with the Rule and was assisted in the hearing by Open Driver Mr Terry Chmiel.

EVIDENCE

Mr Renault showed the video of the start and identified Mr Bamford (PERCY) drawn 5 of 7. He pointed to GLASSY WEBB rear and back away from the barrier and after which CLASSIE WASHINGTON (K Newman) was turned out of line. He said despite the Starter telling the Drivers to stay in line Mr Bamford turned his horse and followed Mr Newman out of line contributing to the delay of the start.

Mr Bamford said there was a lot of noise at the start and he didn’t hear the Starter’s instructions but admitted he wasn’t entitled to turn away as he did.

Mr Chmiel said Mr Bamford was a little unlucky that Mr Newman had turned out of line as it was understandable Mr Bamford would have followed thinking it was a go-around. He added a different Starter had controlled this race.

REASON FOR DECISION:

Mr Bamford having admitted the breach, the charge was deemed proved.

SUBMISSION FOR PENALTY:

Mr Renault stated Mr Bamford was in his first season of driving and had not been charged under any Rule. He alluded to the Guidelines of a $200 fine for an admitted breach, mitigation inclusive.

REASON FOR PENALTY:

There are no factors here to deviate from the Penalty Guidelines.

CONCLUSIONS:

Mr Bamford is fined $200.
