Evidence

Following the running of Race 1, Mr Doyle, Class A Rider admitted a charge alleging excessive whip use prior to the 100 metres.

Rule 638(3)(g)(i) provides that in a Flat Race a Rider must not:

(i) strike a horse with a whip more than 5 times prior to the 100-metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins); or

Using the available race films, Mr Jones demonstrated that Mr Doyle struck his mount 8 times from the straight entrance to the 100-metre mark.  The last strike was close to the 100 metre mark.

Mr Doyle accepted he had used the whip 8 times before the 100 but thought the Rule allowed up to 10 strikes for the whole straight.

Decision

As Mr Doyle admitted the breach, the Adjudicative Committee finds the breach proved.

Submissions for Penalty

Mr Jones advised that Mr Doyle had a clear record for the past six months. The Penalty Guide provides for a $500 fine for a first offence and that was recommended by Mr Jones.

Mr Doyle made no submissions.

Reasons for Penalty

The Penalty Guide starting point for a breach of this nature is $500. After considering the film evidence, the submissions and having due regard for the number of strikes, the Adjudicative Committee determined there were no reasons to depart from the starting point set out in the Penalty Guide. On that basis, Mr Doyle is fined $500.

Conclusion

Mr Doyle is fined $500.
