FACTS:

Following Race 3, Information A15598 was filed with the Adjudicative Committee.

Mr Doyle admitted a breach of Rule 638(3)(f)(ii) in that he struck his mount 3 times above shoulder height.

Mr Doyle said that he understood the Rule and the charge.

Mr Davidson showed film replays and identified Mr Doyle using the whip above shoulder height three times inside the final 200m.

Mr Doyle said that he would not have been charged back home for what he did.

He gave an assurance that he is trying hard to rectify his whip use.

DECISION:

As the charge was admitted, it was deemed proved.

PENALTY SUBMISSIONS:

Mr Davidson said that Mr Doyle had been spoken to at the recent Levin Meeting about his action.  A fine of $250 was recommended.

REASONS FOR PENALTY:

As this was Mr Doyle’s first charge under the Rule, a minimum fine was considered a condign penalty.

CONCLUSION:

Mr Joe Doyle was fined $250.
