Background

Following the running of Race 6, Class D Rider Mr J Parker, admitted a breach of Rule 638(3)(g)(i). The Information read as follows:

‘in that he struck his mount CHICFLIX with the whip eight times prior to the 100 metres’.

Rule 638(3)(g)(i) provides: (g) a Rider must not (i) except as provided for in (iii)(A) and (iii)(B) of this sub rule, strike a horse with a whip more than 5 times prior to the 100 metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins);

The Respondent confirmed that he understood the Rule and admitted the breach.

Evidence:

Mr Jones (Senior Stipendiary Steward), by way of film, identified the incident. Between approximately the 400 metre point and the 100 metre point, the Respondent is seen to strike his mount on 8 occasions, with a further 5 strikes identified between the 100 metres and the finishing line. The Respondent agreed with Steward interpretation/count.

It was noted that the horse ran 3rd.

By way of explanation, Mr Parker stated that his mount responded well to the whip and he had miscounted.

Decision:

As the charge was admitted, it was deemed proved.

Submissions as to Penalty:

Stewards advised the Respondent’s record under this Rule was clear for the past 6 months.

Stewards recommended a penalty in line with the current Penalty Guide ie: a fine of $500 – 1st offence, 3 additional strikes.

Mr Parker explained he understood the Rule, but reiterated that the horse had responded well.

Reasons for Penalty:

The film clearly identified the breach. The current Penalty Guide provides for a $500 fine for a breach of this Rule, 1st offence with 3 additional strikes. Whilst the Adjudicative Committee acknowledges the explanation of the Respondent, it found no compelling reason to deviate from the Guide. Therefore, upon consideration, a fine of $500 was determined to be the appropriate penalty.

Conclusion:

Jockey Mr J Parker (Class D) is fined a sum of $500.
