Penalty: Jockey Tegan Newman is suspended for 5 National Riding Days

Evidence:

Following the running of Race 4, the “EMAC ELECTRICAL 1400”, Mr Dooley presented an Information  charging Ms Newman with careless riding in breach of Rule 638(1)(d).  It was alleged that Ms Newman permitted her mount “CHAMPAGNES ON ME” to shift inwards near the 1000 metre mark when not sufficiently clear of “IRRIGATE” (Mr L Douglas) and “KAIMAI QUEEN” (Ms J Allen), resulting in both those horses being crowded and checked.

Ms Newman admitted the breach of the Rule.

Mr Stewart demonstrated the incident from the race film evidence which showed that Ms Newman when racing 4 wide, near the 1000 metre mark, shifted inwards when not sufficiently clear of Mr Douglas’ mount, “IRRIGATE”, which upon crowding, was dictated onto “KAIMAI QUEEN” causing both horses to be checked.  “IRRIGATE” was prone to racing fiercely which may have aggravated the situation, but “CHAMPAGNES ON ME” was not the required distance clear of it and Ms Newman’s actions comprised, as she admitted, careless riding.

Decision:

As the charge was admitted, it was deemed proved.

Submissions for Penalty:

Mr Dooley assessed the degree of carelessness to be low/medium and said that Ms Newman had a good record with only one suspension in the past year, namely on 10 December 2022.

Ms Newman stated she had committed riding engagements over the next 10 days, and longer.

Reasons for Penalty:

Deferment can only be given for up to 10 days, not beyond that.  From a starting point of 6 days suspension, the Adjudicative Committee allows a discount of 1 day to reflect her record.

Conclusion:

Accordingly, Ms Newman’s Licence to ride is suspended for 5 National Riding Days, to commence at the conclusion of racing on 14 October 2023 and to end at the conclusion of racing on 21 October 2023.
