R Tauranga 16 November 2024 – R8 – Joe Nishizuka

EVIDENCE:

Following the running of Race 8, the “BOOTH’S LOGISTICS 1600”, Mr Jones presented an Information charging Mr Nishizuka, the Rider of GIGI with careless riding, in breach of Rule 638(1)(d).

It was alleged that Mr Nishizuka permitted his mount GIGI to shift outwards near the 375 metres mark when not sufficiently clear of BASSOROC (ridden by G Rooke), which was required to be checked.

Mr Nishizuka admitted the charge.

The evidence apparent from the race film disclosed that GIGI, the very warm favourite, was travelling well towards the inside and Mr Nishizuka was riding a clear run to contest the finish.  BASSOROC was immediately behind and to the outside of GIGI.  In seeking room, Mr Nishizuka angled his mount outwards, but insufficiently clear of BASSOROC.  In order to prevent a possible clipping of heels, Mr Rooke had to restrain and check his mount, losing several lengths, ending up in 5th place.  GIGI has gone strongly on to finish in second place.

DECISION:

As the charge was admitted, it was deemed proved.

SUBMISSIONS FOR PENALTY:

Mr Jones expressed the view that the breach was in the mid range of careless riding.  Mr Nishizuka had a clear record over the past 12 months, having had 142 rides over that period.

Ms Gerard submitted that Mr Nishizuka’s mistake arose only out of his youth and inexperience.

REASONS FOR PENALTY:

From a recommended starting point of a suspension for 7 days, the Adjudicative Committee regards Mr Nishizuka’s excellent record as deserving of a discount of 2 days.

CONCLUSION:

Accordingly, his Licence to ride is suspended for 5 National Riding Days, to commence at the conclusion of racing on 24 November 2024 and to end at the conclusion of racing on 1 December 2024.
