FACTS:
Mr Innes the Rider of “UDERZO”, admitted a breach of Rule 638(3)(g)(ii) in that he struck his mount in two consecutive strides near the 100 metres.
Mr Innes confirmed to the Adjudicative Committee that he understood the Rule, charge and that he admitted the breach.
Mr Oatham showed film replays and pointed out where Mr Innes had struck his mount in two consecutive strides.
Mr Innes agreed and had nothing further to add.
DECISION:
As the charge was admitted, it was deemed proved.
PENALTY SUBMISSIONS:
Mr Jones said that Mr Innes had a clear record with one warning only.
Mr Innes did not comment.
REASONS FOR PENALTY:
The Penalty Guide starting point is for a fine of $150. As there was no reason to depart from the starting point a fine of $150 was considered appropriate.
CONCLUSION:
Mr Innes was fined $150.
