Evidence:
Following the running of Race 4, the “Classic Builders 1215” and upon the disqualification of “TREASURE STATE” by this Committee, an Information was presented by Mr Williamson charging Mr Yanagida with a breach of Rule 649(3) in that he weighed in 0.6kg under the weight required of him.

Mr Yanagida admitted the breach.

“TREASURE STATE” was disqualified with Rule 648(3).

In explanation, Mr Yanagida said that he was holding 2 lead pieces in his hands when weighing out and overlooked adding them to his saddle bags when he was back in the Jockeys’ Room
He was very remorseful of his mistake.

Decision:
As the breach was admitted it was deemed proved.

Penalty Submissions:
Mr Williamson advised that where such a breach has resulted in a disqualification of a horse which was not finished in stake earning place, fines of between $100 and $500 has been usual and that no Punter, Owner or Connection suffered any loss and Mr Yanagida’s acceptance that he was very fortunate, as events turned out. T

Penalty:
The Committee imposed a fine of $200.
