Evidence:

Following the running of Race 5, the “Greenlight Insurance Brokers 1400”, and the Decision of the Adjudicative Committee to uphold the protest by the 2nd placed horse (“BILLY BUNTER”), against the 1st placed horse (“LORD JIMMY”) ridden by Mr D Danis, Mrs Selvakumaran presented an Information charging Mr Danis with careless riding in breach of Rule 638(1)(d).

The Information alleged that Mr Danis “permitted his mount to shift outwards when not sufficiently clear of “MADIRAN” which had to check off “LORD JIMMY’S” heels and as a result, “HEY HEY BABY”, “GRACE ‘N’ GLORY” and “BILLY BUNTER” all suffered interference to varying degrees passing the 350 metres.”

Mr Danis admitted the charge.

The circumstances and evidence relating to the events are outlined in the Adjudicative Committee’s written reasons for upholding the protest under Information A17856.  The interference – for the purpose of the Protest Decision, suffered by “BILLY BUNTER” was caused by Mr Danis allowing his mount to impede 3 other horses when insufficiently clear, so as to severely hamper “BILLY BUNTER” when they took evasive action.

Decision:

As the charge was admitted, it was deemed proved.

Submissions for Penalty:

The Informant advised that Mr Danis has had one previous breach of this Rule in the past year (on 16 October 2023) and expressed the opinion that the present breach was in the mid/low range.

Reasons for Penalty:

The Adjudicative Committee assessed it as midrange and applying the recommended “starting point” guide, imposed a suspension of Mr Danis’ Licence for 8 National Riding Days.

Conclusion:

Mr Danis is suspended for 8 National Riding Days, commencing at the conclusion of racing on 16 December 2023 and to end at the conclusion of racing on 28 December 2023.
