Penalty: Class A Rider Darren Danis is fined $500

Evidence

Following the running of Race 11, Information No. A17246 was filed alleging a breach of Rule 638(3)(g)(i) in that Class A Rider Mr D Danis struck his mount (CARRINGTON) six times prior to the 100-metre mark.

At the commencement of the hearing Mr Danis confirmed that he admitted the charge.

Rule 638(3)(g)(i) provides that in a Flat Race a Rider must not:

(i) strike a horse with a whip more than 5 times prior to the 100-metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins); or

Using the available race films, Stipendiary Steward Mr Jones identified CARRINGTON (D Danis) who was racing close to the running rail.  He demonstrated that Mr Danis struck his mount six times from the straight entrance to prior to the 100-metre mark.

Mr Danis agreed with the number of strikes and had nothing further to add.

Decision

As the Respondent admitted the charge, the Adjudicative Committee finds the charge proved.

Penalty submissions

Mr Jones submitted that Mr Danis has had two previous breaches of this Rule in the past 6 months, namely:

10/09/22 – 7 strikes – fined $500

22/06/22 – 8 strikes – 6-day suspension

Mr Jones submitted that the Penalty Guide provides for a $500 fine.

Mr Danis did not offer any submissions as to penalty.

Reasons For Penalty

The Penalty Guide provides for a $500 fine for a third breach involving one additional strike.

There are no mitigating or aggravating factors. On that basis there are no reasons to deviate from the Penalty Guide starting point.  Accordingly, Mr Danis was fined $500.

Conclusion

The Respondent Mr Danis was fined $500.
