SUMMARY OF FACTS:
Mr Fannin the Rider of ZARTAN in the CLC Pakuranga Hunt Cup was charged with using his whip twelve times prior to the 100m.
 EVIDENCE:
Mr Jones showed the film replays and identified where Mr Fannin had struck his horse 12 times (10 is the limit).
Mr Fannin agreed with the number of strikes.
REASON FOR DECISION:
As the charge was admitted and it was clear that Mr Fannin had struck his mount 12 times, it was deemed proved.
SUBMISSION FOR PENALTY:
Mr Jones said that Mr Fannin had a clear record in the last 12 months. He said that ZARTAN finished 2nd and the prizemoney was $9,250.
He added that the penalty clause for a first offence is a $250 fine or 50% of the Jockey’s share of the stake, whichever is the greater.
Mr Fannin said that it was his first breach for a long time.
REASON FOR PENALTY:
Mr Fannin’s share of the $9,250 prizemoney was in round figures $900, with 50% being $450.
CONCLUSIONS:
Mr Fannin was fined $450.
