SUMMARY OF FACTS:
Mr Lammas was charged with failing to make the declared weight for ALFIE DEE (Race 3) and IMA WONDER (Race 1).
EVIDENCE:
Mr Jones said that normally the matter would have been dealt with under the Minor Infringement, however due to ALFIE DEE being in a prestigious Jumping Race with a stake of $50,000 the Stewards believed a higher penalty should be imposed.
Mr Lammas was approximately 1kg over the carded weight.
REASON FOR DECISION:
As the charge was admitted it was found proved.
SUBMISSION FOR PENALTY:
Mr Jones said that Mr Lammas had one prior breach on 8 May 2021 with a fine of $100 imposed under the Minor Infringement.
Mr Lammas said that he had tried hard to make the weights but due to saunas being closed down during lockdown, it had made it very difficult to shed weight.
REASON FOR PENALTY:
The Committee gave due consideration to all submissions and determined that a suitable penalty for the breach was a fine of $200.
 CONCLUSIONS:
Mr Lammas was fined $200.
