FACTS
Ms Kayla Macnab admitted a breach of Rule 638(3)(g)(i). The breach being that she struck her mount ‘WHISKEY TANGO’ 6 times with the whip prior to the 100m (5 is the limit).
Ms Macnab said that she knew the Rule, charge and confirmed that she admitted the breach.
Film replays clearly showed the 6 strikes being applied. Ms Macnab agreed.
DECISION
As the charge was admitted, it was found proved.
PENALTY SUBMISSIONS
The records showed that this was Ms Macnab’s second breach of the Rule, the first being on 24 April 2023, when a suspension of 1-day was imposed. 8 strikes were applied on that occasion.
Ms Macnab asked for a suspension to be considered.
REASONS FOR PENALTY
The Penalty Guide for a second breach provides for a fine of $250.
CONCLUSION
For the sake of consistency, Ms Macnab was fined $250.
