Penalty: Jockey Stephan Karnicnik fined $250

Evidence:

Following the running of Race 2, the Tele Otaki Jumpers Flat, Respondent Stephan Karnicnik (Class D Rider), admitted a charge alleging excessive whip use (6 strikes) prior to the 100 metre mark.

Rule 638(3)(g)(i) provides that in a Flat Race a Rider must not:

(i) strike a horse with a whip more than 5 times prior to the 100 metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins).

Using available film, Stipendiary Steward Mr Coppins identified that Mr Karnicnik struck his mount on 6 occasions between the top of the straight and the 100 metre mark. Mr Karnicnik agreed with count

Decision:

As the Respondent admitted the breach, the Adjudicative Committee finds the the breach proved.

Submissions as to Penalty:

Mr Coppins advised the the Respondent had received a warning relating to a breach of this Rule at the Auckland Thoroughbred Racing meeting on 22nd March 2023. This is the only breach noted within the last six months. The Adjudicative Committee was referred to the current Penalty Guideline as it related to Jumps and Highweight races.

Reasons for Penalty:

The NZTR Penalty Guide provides for a fine of $250 for a second breach involving 1 additional strike beyond that permitted. The Adjudicative Committee found no material reason to depart from same.

Conclusion:

Mr Karnicnik is fined a sum of $250.
