Penalty: Rider Vikas Jalalkuncha is suspended for 6 days

Evidence:

Following the running of Race 7 the Respondent admitted a charge of excessive whip use which was filed pursuant to Rule 638(3)(g)(i). Details are as follows:

“in that V Jalalkuncha (Monkey Town) used his whip excessively prior to the 100 metres (7 times) “

The Respondent acknowledged that he understood the Rule and admitted the breach.

Rule 638(3)(g)(i) provides a rider must not:

“strike a horse with a whip more than 5 times prior to the 100 metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins)

Using available film, Stipendiary Stewards identified the 7 occasions on which the Respondent struck his mount, essentially between the top of the straight and the 100 metre mark. The Respondent confirmed that he agreed with the count.

Decision:

As Mr  Jalalkuncha admitted the charge the Adjudicative Committee found the breached proved.

Submissions for Penalty:

Mr Coppins outlined the Respondent’s recent record namely.

1st July 2022 – 6 strikes – warning

7th August 2022 – 7 strikes – $500 fine

28th August 2022 – 8 strikes – 5 days suspension

Mr Coppins drew the Adjudicative Committee’s attention to the current Penalty Guide which provides for a 5+ day suspension for a breach of this type. The Respondent advised that he did not hold riding engagements, with any suspension able to take effect immediately.

Reasons for Penalty:

The Adjudicative Committee considered evidence and submissions. Given the recent record, a suspension of 6 riding days is deemed appropriate.

Conclusion:

The Respondent’s licence to ride in races is suspended for 6 National Riding Days, from completion of racing on 15th September 2022 up to and including racing on 23rd September 2022.
