FACTS

Mr Vikas Jalalkuncha admitted a breach of Rule 638(3)(g)(i).  It was alleged that he used his whip excessively on “MONKEY TOWN” prior to the 100m (7 strikes when the limit is 5 strikes).

Mr Jalalkuncha said that he understood the Rule, Charge and confirmed that he admitted the breach.

Film replays were shown which clearly showed Mr Jalalkuncha striking his mount 7 times with the drawn whip prior to the 100m.

DECISION

As the charge was admitted it was deemed proved.

PENALTY SUBMISSIONS

The record showed that the Respondent had had one prior warning within the last six months.  The Penalty Guide was referred to which showed a starting point of a $500 fine for 7 strikes following a warning.

Mr Jalalkuncha advised that he had had 700 Race rides in India and 4 in New Zealand.

REASONS FOR PENALTY

Taking all matters into consideration a fine of $500 was considered to be a suitable penalty.

CONCLUSION

Mr V Jalalkuncha was fined $500 for the breach of Rule 638(3)(g)(i)
