Background
Miss Haley alleged that in Race 6 Mr Toolooa allowed his mount EMANON to shift in when not clear of EPTIMUM (R Mudhoo) who was checked near the 900 metres.
Mr McIntyre demonstrated on the videos that the Respondent was making a run to the rail from a wide barrier draw and came into the path of Mr Mudhoo who had to take a hold. He played both the side on and head on videos which evidenced that Mr Toolooa was not his length and another clear.
Mr Moseley said Mr Toolooa was coming across nicely but had not allowed Mr Mudhoo sufficient room on the corner. He said horses step in on a bend and this was what had happened on this occasion. He said there was only a couple of strides in it.
Mr Toolooa agreed with what Mr Moseley had said on his behalf and added that there had been no yelling from the jockeys on his inside.
Decision
As Mr Toolooa has admitted the breach, it is found to be proved.
Submissions as to penalty
Miss Haley produced the Respondent’s record which showed two breaches of the careless riding Rule in the previous six months. He was suspended for seven days in July and four days in November. Miss Haley described the breach as being low to mid-range. She added it was a Listed Race.
Mr Moseley believed the breach was low range. Mr Toolooa requested that any suspension be deferred until after racing at Riverton on 1 January 2023.
Reason for Penalty
The Breach is assessed as being at the lower end of mid-range. A Jockey coming across the field from a wide barrier must always ensure that the horses to his inside are given sufficient room. On this occasion Mr Toolooa was crossing on the apex of the corner and EPTIMUM, which had drawn the barrier immediately to his inside, had to be restrained. Factoring in that this is a Listed Race, a six-day starting point is appropriate. When regard is had to the fact that Mr Toolooa rides regularly, his record is neutral. A one-day discount is given for admission of the breach.
Conclusion
Mr Toolooa is suspended from the end of racing on 1 January up to and including 6 January 2023. This is 5 days.
