Background

Miss Haley alleged that in Race 5 Mr May struck his mount OUR CLARRY six times prior to the 100 metres.

Mr McIntyre demonstrated on the videos that the Respondent was making a run on the rail and struck his mount OUR CLARRY 6 times prior to the 100 metres.  Mr May said he had a made a mistake. He had paused with his use of the whip and thought he would have been okay.

Decision

As Mr May has admitted the breach, it is found to be proved.

Submissions as to penalty

Miss Haley produced the Respondent’s record which showed one breach in the previous six months, on 29 July last. Miss Haley submitted that a penalty in accordance with Guidelines was appropriate.

Mr May accepted this.

Reasons for Penalty

The NZTR Guidelines provide for a fine of $250 where there is one additional strike, and the Jockey has a previous breach in the past six months.

Conclusion

Mr May is fined the sum of $250 and is reminded of his obligations under the Whip Rules.
