EVIDENCE:

Following the running of Race 8, Stipendiary Steward Mrs Rebecca Haley presented an Information alleging a breach of Rule 638(3)(g)(i) by Class A Jockey Mr Brandon May.

Mr May stated he was conversant with the Rule and the Charge and confirmed he admitted the breach.

Mrs Haley played the race video and had Stipendiary Steward Mr Mark Davidson identify Mr May (GABBY DIAZ) racing widest on the track rounding the final bend. Mr Davidson counted 10 strikes, finishing well before the final 100m mark.

Mr May said his horse was a lazy type and the track today was very testing.

DECISION:

The Respondent having admitted the breach, the charge was deemed to be proved.

SUBMISSIONS FOR PENALTY:

Mrs Haley stated Mr May has 1 previous breach of the Rule on 23 February 2024 when he struck his horse 8 times, resulting in a 5-day suspension.

Mrs Haley said the Stewards viewed this breach at high level and sought a significant uplift from the starting point suggested in the Guidelines.

Mr May made no submissions for Penalty, but asked for a deferment of Penalty until after the 16 May 2024.

REASONS FOR PENALTY:

The Penalty Guidelines provide a 5+day suspension for a second breach at high level.

The Adjudicative Committee agrees this breach is at high level, 10 strikes. An appropriate sanction for such a breach may attract a 7 or 8 day suspension, however, this would only penalise Mr May one day of riding, being purely a South Island Rider. To impose a meaningful Penalty, which this breach demands, compels the Adjudicative Committee to suspend Mr May’s Licence for 9 days to encompass a second South Island day’s Racing.

A deferment is granted for Mr May.

CONCLUSION:

Jockey Mr Brandon May’s Licence to ride in races is suspended for 9 days, from the conclusion of racing on 16 May 2024, up to and including racing on 31 May 2024.
