EVIDENCE:

Mr Davidson alleged that Mr Khetoo permitted his mount CARLOS to shift ground when not sufficiently clear passing the 950 metres crowding and checking PICKENS with the Rider being dislodged.

Miss Haley demonstrated on the videos that the Respondent was racing midfield when he allowed his mount to shift in. He was only 3/4 of a length clear of PICKENS, which clipped a heel and fell.

SUBMISSIONS:

Mr Khetoo said he heard yelling from Mr Campbell and was trying to straighten his mount, but he was too late.

Mr Tyler said it was inexperience on Mr Khetoo’s part. Mr Khetoo had thought he was clear, and it was a lack of judgement. He had shifted 2 strides too soon and had not given Mr Campbell a chance to ease back.

DECISION:

As Mr Khetoo has admitted the breach it is found to be proved.

SUBMISSION FOR PENALTY:

Mr Davidson produced Mr Khetoo’s record which showed 2 previous breaches of the careless riding Rule this season. He received a 6-day suspension on each occasion. Mr Davidson identified the starting point as a 4-week suspension. He said at no stage was Mr Khetoo clear of Mr Campbell, who had been taken to hospital for observation as a result of the fall.

Mr Tyler asked for a deferment until after the Gore meeting on the 27th.

REASON FOR PENALTY:

Mr Khetoo has shifted ground when not clear of PICKENS. That horse was crowded and checked, eventually clipping a heel, and dislodging its rider passing the 950 metres.

Mr Khetoo has had 65 lifetime rides and has been in breach of the careless riding rule on 2 occasions prior to today. A horse has fallen as a result of his actions. The starting point is a 4-week suspension. Any increase for record is balanced by Mr Khetoo’s admission of the breach.

CONCLUSION:

Mr Khetoo is suspended for 4 weeks from 28th October up to and including 24th November.
