Penalty: Jockey Brandon May is fined $500

Mr Davidson alleged that Mr May struck his mount six timesĀ  prior to the 100 metres in Race 3.

Miss Haley demonstrated on the video that Mr May (FAME SHINES) was making up ground prior to the 100 metres. When so doing, Mr May struck the horse six times with the whip.

Mr May agreed with this count and said he had been instructed to get the horse into the race before the 100 metres. He had miscounted.

Mr Davidson stated that the Respondent was only some 20 metres or a couple of strides from remaining within the Rules.

As Mr May has admitted the breach, it is found proved.

Mr Davidson produced the Respondentā€™s record which showed two previous breaches of this Rule on 25 February last. The two breaches were on the same day and Mr May was fined $250 and $500, respectively.

Mr Davidson submitted that a penalty in accordance with the Penalty Guidelines was appropriate. Mr May agreed with this.

Mr May has encouraged FAME SHINES to make up ground prior to the 100 metres and, in so doing, he has struck the horse six times. The revised Penalty Guidelines provide a penalty of a fine of $500 for a third breach where there is one additional strike.

Mr May is fined the sum of $500.
