Penalty: Driver Ricky May is fined $200

SUMMARY OF FACTS:

Mr Renault alleged that Mr May shifted out near the 1650 metres forcing SPRINGBANK MASON wider on the track.

SUBMISSIONS:

Mr Renault demonstrated on the videos that Mr May was racing near the rear of the field at the 1800 metres. Mr Williamson has progressed to his outside and Mr May then shifts out forcing Mr Williamson three-wide on the track. Eventually, Mr Williamson moves round the outside of the field and takes the lead.

Mr May said he was unlucky as it appeared Mr Williamson was going to go round and take the lead, anyway. He said his horse was trotting roughly at the time and he thought he was clear of Mr Williamson but obviously he was not.

REASON FOR DECISION:

Mr May has admitted the breach. It is found to be proved.

SUBMISSION FOR PENALTY:

Mr Renault produced Mr May’s record. It is clear under this Rule. Mr May had nothing further to add.

REASON FOR PENALTY:

Mr May has shifted out and in so doing has pushed Mr Williamson wider on the track in breach of the Pushout Rule. Mr May is unlucky to some extent in that it appears Mr Williamson was going to go round the field and take the lead in any event.

Mr May has an excellent record in that he has had 672 drives this season without a breach of this Rule. He has also admitted the breach.

CONCLUSIONS:

A fine of $200 is imposed.
