EVIDENCE:
Mr Ydgren showed the available videos of the last 75 metres of the race. He demonstrated CALL THIS FUN in the middle of the track trot roughly and then break its gait at approximately the 50-metre mark and continue on in a gallop past the winning post. Mr Ydgren commented that it would be difficult to assess if CALL THIS FUN had galloped just before, on or just after the 50-metre pole.
Mr Ford was adamant his horse had not galloped for 50 metres or more.
REASON FOR DECISION:
The Committee in viewing the videos, which needed to be precise in this instance but were not, considered CALL THIS FUN had broken out of its gait at almost exactly the 50-metre pole but could not be certain without doubt it had breached the Breaking Horse Regulations.
CONCLUSIONS:
The protest was dismissed and it was ordered stakes and dividends be paid in accordance with the Judge’s placings.
