EVIDENCE:
Following the running of Race 4, Stipendiary Steward Mr Shane Renault presented an Information alleging a breach of Rule 869(2) by Open Driver Mr Robbie Holmes.
Mr Holmes stated he was conversant with the Rule, the charge, and confirmed he admitted the breach.
Mr Renault showed the relevant videos to identify Mr Holmes finishing wide on the track, and striking his horse 4 or 5 times with more than a wrist flicking motion.
Mr Holmes agreed with Mr Renault’s assessment.
DECISION:
The Respondent having admitted the breach, the charge was deemed to be proved.
SUBMISSIONS FOR PENALTY:
Mr Renault said Mr Holmes was charged at Banks Peninsula on 10 April 2023 and was suspended for 2 days. He said the Stewards viewed the breach as between low and mid-range and this being a second breach, a suspension is in order.
Mr Holmes made no submissions, but asked to start any suspension after Sunday’s racing on 2nd July.
REASONS FOR PENALTY:
The Penalty Guidelines provide a 3-day suspension for a second breach at low level, which the Adjudicative Committee determines this is.
There are no aggravating factors to depart from the Guidelines and accordingly, find a 3-day suspension as an appropriate penalty in this case.
CONCLUSION:
Open Driver Mr Robbie Holmes’ Licence to drive in races is suspended from 7 July 2023 to 13 July 2023 inclusive.
