EVIDENCE:

Following the running of Race 1, Stipendiary Steward Mr Matt Sole presented an Information alleging a breach of the Home Straight Regulations by Amateur Driver Mr Mike Maynard.

Mr Maynard stated he understood the Rule and the Charge and had signed the Information “I do admit the breach”.

Mr Sole played all available videos to identify Mr Maynard (MACK PACK) 5 wide entering the home straight. He pointed to MACK PACK shift inwards gradually for 200m, eventually finishing third beside the winner, who at the finishing line, was one off the pylons. Mr Sole said there was some outward movement from the winner of the race WARLOCH, but Mr Maynard has made no attempt to straighten his drive and has shifted in approximately 2 sulky widths, hampering DON JUAN.

DECISION:

The Respondent having admitted the breach, the charge was deemed to be proved.

SUBMISSIONS FOR PENALTY:

Mr Sole stated Mr Maynard had a clear record, and he would have to decide whether he would prefer a fine or suspension as penalty, as per the Guidelines.

Mr Maynard said he would be taking a suspension as Penalty.

REASONS FOR PENALTY:

The Penalty Guidelines provide a $300 fine or a 2-day suspension for a breach of this Rule. Mr Maynard prefers a suspension, which for an Amateur Driver, equates to a one-month suspension.

There are no factors for the Adjudicative Committee to consider departing from the Guidelines on this occasion.

CONCLUSION:

Amateur Driver Mr Mike Maynard is suspended from the conclusion of racing today, up to and including racing on 27 August 2025.
