BACKGROUND:
Following the running of Race 7, Garrards’ Premier Mares’ Championship Mobile Pace (Group 2), Open Driver, Ricky May, admitted a breach of Rule 869(7A)(a) in that, as the Driver of BOUDICA in the race, he allowed his horse to strike track markers leaving the final bend.
The Information was filed on racenight and adjourned. It was heard at the meeting of Methven TC at Mt Harding Racecourse, Methven, on 28 January 2024.
The Respondent was not present at the hearing, but he had signed the Information “I do admit a breach of the rule”.
EVIDENCE:
Stipendiary Steward, Shane Renault, showed a video replay of the incident. He pointed out BOUDICA, driven by the Respondent, racing on the markers towards the rear of the field. He then showed that the Respondent’s sulky wheel struck a pylon rounding the final bend.
SUBMISSIONS FOR PENALTY:
Mr Renault said that the breach normally attracts a fine of $100 under the Minor Infringement Scheme. The race was a Group 2 Race and, accordingly, Stewards had filed an Information and were seeking a fine of $200, he said.
REASONS FOR PENALTY:
The Adjudicative Committee accepted that a fine of $200 was appropriate, having regard to the Group 2 status of the race.
CONCLUSION:
Open Driver, Ricky May, was fined the sum of $200.
