EVIDENCE:

Following the running of Race 1, the IRT. YOUR HORSE. OUR PASSION (NZ AM DRIVERS CHAMPS) MOB PACE, Stipendiary Steward Mr Shane Renault presented an Information alleging a breach of Rule 869(2) by Amateur Driver Miss Cheree Wigg.

The Hearing of the Information was adjourned sine die and heard today, Sunday 23 June 2024.

Stipendiary Steward Mr Paul Williams, filled in as the Applicant in the absence of Mr Renault.

The race videos showed Miss Wigg (SARGENT BEST) finishing widest on the track, using her whip continuously, with no pauses. Mr Williams stated the strikes were of very low force and the breach was low level.

Miss Wigg made no submissions.

DECISION:

As the charge was admitted, it was deemed proved.

SUBMISSIONS FOR PENALTY:

Mr Williams said this was a first breach for Miss Wigg and alluded to a choice for her of a 2-day suspension or a $300 fine.

Miss Wigg chose the latter.

REASONS FOR PENALTY:

The Adjudicative Committee could find no factors to depart from the Guidelines on this occasion.

CONCLUSION:

Amateur Driver Cheree Wigg is fined $300.
