EVIDENCE:

Following the running of Race 4, the LATHER UP DUAL WORLD CHAMPION MOBILE PACE, Stipendiary Steward Mr Shane Renault presented an Information alleging a breach of Rule 869(2)(b) by Driver Chris Butt.

Mr Butt stated he was conversant with the Rule, the Charge and he confirmed he admitted the breach.

Mr Renault played the race video to identify Mr Butt (SWEET MIKI) racing in last position approaching the final bend. He pointed to Mr Butt use his whip several times with force and more than a wrist flicking motion. Mr Renault showed, as the horses entered the home straight, SWEET MIKI was out of contention, but Mr Butt continued to drive with his whip aggressively in breach of the Regulations.

Mr Butt made no submissions.

DECISION:

The Respondent having admitted the breach, it was deemed to be proved.

SUBMISSIONS FOR PENALTY:

Mr Renault stated Mr Butt had driven 27 times this season and was suspended under the Rule for 2 days on 23 May at Addington. He said there have been two factors at play here, with Mr Butt using his whip when out of contention and his whip action which falls well below the accepted standard.

Mr Renault said both factors were considered by Stewards as mid-range and a 4-day suspension would be a suitable penalty.

Mr Butt made no submissions on Penalty.

REASONS FOR PENALTY:

The Penalty Guidelines provide a 4-day suspension for a second breach of this Rule at mid-range. The Adjudicative Committee after considering all factors, can see no reason to depart from the Guidelines on this occasion.

CONCLUSION:

Open Driver Chris Butt is suspended for 4 days from the conclusion of racing on 21 July 2024, up to and including racing on 4 August 2024.
