EVIDENCE:
Following the running of Race 1 Amateur Driver, Mr Barry White was charged with using his whip free of the rein.
Mr Ydgren showed the race film to identify Mr White driving WOLFENSTEIN on the inner in the home straight. He pointed to Mr White pull his horse away from the inside, cross his reins to turn and use his whip. From this point, Mr Ydgren stated Mr White has failed to regain the right rein from his left hand and therefore in breach of the Rule.
REASON FOR DECISION:
Mr White having admitted the breach the charge was therefore proved.
SUBMISSION FOR PENALTY:
Mr Ydgren stated Mr White had been warned and also spoken to about his whip use recently. He said it was Mr White’s first charge under the Rule and could be dealt with by way of a fine as per the Penalty Guidelines.
REASON FOR PENALTY:
Mr White has driven with his whip free of the rein for a period in the home straight. There are no aggravating factors to consider and he has conducted himself professionally at the hearing.
The Committee considers a fine of $200 to be appropriate in this case.
CONCLUSIONS:
Amateur Driver Mr Barry White is fined $200.
