Mr McIntyre alleged that Mr White used his whip free of the rein in the home straight.

Summary of facts

Mr McIntyre identified the Respondent’s horse on the video and demonstrated that Mr White used the whip free of the rein in the run home. He said there were 2 such strikes.

Mr White apologised and explained he had reverted to the old-style whip use. He was not aware that he had done so at the time.

Decision

As Mr White has admitted the breach, it is found to be proved.

Penalty submissions

Mr McIntyre produced the Respondent’s record.  Mr White had been fined $200 under this Rule on 17 September 2021. Mr McIntyre sought a suspension of between 3 to 5 drives.

Mr White submitted that the suspension should be as short as was appropriate and asked for a deferment until after Roxburgh on 4 January.

Penalty

The breach is mid-range in that the Respondent has use his whip free of the rein. While there are 2 strikes, these are reasonably forceful.

Mr White’s record under this Rule shows one breach these past 12 months. He has had only 4 drives since his previous breach.

Mr White is suspended from the end of racing on 4 January up to and including 11 February 2022. This is calculated to be approximately 3 to 4 drives.
