Penalty: Driver Robbie Close is fined $500

EVIDENCE:

Following the running of Race 9, Stipendiary Steward Mr Shane Renault presented an Information alleging a breach of Rule 869(2) by Driver Robbie Close in that he “used his whip with more than a wrist flicking motion”.

The Information was opened and adjourned sine die and heard this day, 23 August 2024 at Addington Raceway.

Mr Close stated he understood the Rule, the Charge, and confirmed he admitted the breach.

The race videos were used to identify Mr Close (HILDA MAUD) finishing strongly down the middle of the track where Stewards alleged, he has used his whip on several occasions that were outside of the Guidelines. Mr Renault said Mr Close has been compliant over the last 50m, but the aggravating factor is that HILDA MAUD has won the race.

Mr Close said he freely admits he was in the wrong.

DECISION:

As the charge was admitted, it was deemed proved.

SUBMISSIONS FOR PENALTY:

Mr Renault said Mr Close is a very busy Driver, with 328 drives this season and has a clear record under the Rule. He said Stewards view this breach at mid-level, with the aggravating factor of the horse winning the race and are seeking a fine of $500 as penalty.

Mr Close said he believed a fine of $300 would be acceptable, as he has been compliant over the last part of the straight.

REASONS FOR PENALTY:

The Penalty Guidelines provide a $500 fine, or a 2-day suspension for a first breach of this Rule at mid-level.

The Adjudicative Committee agrees this breach is at mid-level and on considering all factors, finds a fine of $500 to be appropriate in the circumstances of this race.

CONCLUSION:

Driver Robbie Close is fined $500.
