Evidence

Following the Wairoa RC Meeting held at Waipukurau on 15 February 2026, the Respondent Elen Nicholas (Apprentice Jockey) admitted a charge alleging excessive whip use prior to the 100 metres.

The hearing of the breach was heard at the Riccarton Park – Canterbury JC Meeting at Riccarton Park on 18 February 2026.

The Respondent stated she was conversant with the Rule and the Charge and confirmed she admitted the breach, which was found proved accordingly.  Apprentice Mentor Mr Jason Laking was present to assist.

Rule 638(3)(g)(i) provides that in a Flat Race a Rider must not:

(i) strike a horse with a whip more than 5 times prior to the 100-metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins). 

Using the available race films, Chief Stipendiary Steward Mr Oatham demonstrated that Miss Nicholas struck her mount 8 times in the straight prior to the 100m.

Miss Nicholas and Mr Laking agreed the number of strikes was correct.

Submissions for Penalty

Mr Oatham produced Miss Nicholas’ record, which indicated a clear record. Mr Oatham said the Penalty Guide specifies for three additional strikes, first offence, a $500 fine. He said Miss Nicholas’ mount has gone on to run second in the race, beaten a nose and the Stewards don’t believe there are any aggravating features to consider.

Miss Nicholas and Mr Laking made no submissions regarding penalty.

Reasons for Penalty

The Penalty Guide provides a $500 fine, first offence, for 3 additional strikes.

After considering the film evidence, the submissions and having due regard for the number and frequency of strikes and the force used, the Adjudicative Committee determined there are no compelling reasons to depart from the starting point set out in the Penalty Guide.

Conclusion

Apprentice Jockey Elen Nicholas is fined $500.
