FACTS

Ms Sutherland the Rider of “HAPPY STAR” admitted a breach of Rule 638(3)(g)(i) in that she struck her mount with the whip 6 times prior to the 100m (5 is the limit).

Ms Sutherland confirmed to the Committee that she understood the Rule, Charge and confirmed that she admitted the breach.

The film replays were crystal clear in showing Ms Sutherland had struck her mount 6 times before reaching the 100m.

Ms Clapperton agreed and said that Ms Sutherland has to be mindful at all times that the maximum number of strikes before the 100m is 5.

DECISION

As the charge was admitted it was deemed proved.

PENALTY SUBMISSIONS

Ms Algar said that on 21 May 2022 Ms Sutherland was fined $125 for a breach in a Listed Race.

She agreed that normally a warning would have been issued on that occasion, but as it was a Listed Race a charge was preferred.  Ms Algar suggested that a penalty in line with a first breach be considered for this current breach.

Ms Clapperton agreed.

REASONS FOR PENALTY

The Committee agreed with the submissions made and imposed a fine of $250.
