FACTS:
Following Race 3 Information A17261 was filed with the Adjudicative Committee.
Mr Poutama Driver of “HAIL LUCIUS” (first) admitted a breach of Rule 869(4)(6)(b)(c) in that he pushed out approaching the 1000m and forced “UNCLE DREW” (D Butcher) to race wide on the track.
Mr Poutama said that he knew the Rule and Charge and confirmed that he admitted the breach.
Mr P Williams showed film replays and identified the push out incident which was 30m prior to the 1000m.
Mr Poutama agreed with the Stewards interpretation.
DECISION:
As the charge was admitted it was deemed proved.
PENALTY SUBMISSIONS:
The record showed all clear for Mr Poutama.
Mr Mulcay said that $250 was the starting point but historically for an admitted breach, a fine of $200 has been imposed.
Mr Poutama said that he thought that he had past the 1000m.
REASONS FOR PENALTY:
After pushing out Mr Poutama ended in the one-one position and went on to win the event.
Mr Butcher and his drive were forced 3-wide for some distance.
Considering all of the circumstances the starting point penalty of $250 was considered appropriate.
CONCLUSION:
Mr Poutama was fined $250.
