FACTS
Following Race 3, Mr Pyers admitted a breach of Careless Driving.
The carelessness being that near the 100m, he allowed his drive ‘LOUIE V TONNE’ to cause interference to ‘THE MAESTRO’ (P Ferguson) which broke as a result.
Mr Pyers said that he understood the Rule, charge and confirmed that he admitted the breach.
Film replays were shown, with Mr Sole stating that Mr Pyers’ drive shifted in onto ‘THE MAESTRO’, which resulted in THE MAESTRO’s off-hind leg catching the inside hind leg of Mr Pyers’ drive. As a consequence ‘THE MAESTRO’ went off-stride and broke.
Mr Sole said that ‘THE MAESTRO’ did shift out a little.
Mr Pyers said that he did attempt to keep off ‘THE MAESTRO’ and that it all happened quickly. He added that the inside horse did shift out.
DECISION
As the charge was admitted, it was deemed proved.
PENALTY SUBMISSIONS
Mr Mulcay said that Mr Pyers had a clear record. He said that Mr Pyers had had 10 drives this season and 9 drives last season. Mr Mulcay added that the clear record and guilty plea be given consideration.
Mr Pyers said that he has a good record.
REASONS FOR PENALTY
The Penalty Guide starting point for Careless Driving is a suspension of 3-driving days.
Taking into account the record and guilty plea, a 2-driving day suspension was considered to be a suitable penalty.
CONCLUSION
Mr Pyers’ Driver’s Licence was suspended from close of racing on 31 March, up to and including 14 April 2023. The days being 6 April and 14 April at Cambridge.
