Penalty: Rider Chris Dell is suspended for 6 NR Days

Background:

Following the running of Race 2, the ‘Happy Hire 3yo Maiden’, an Information was lodged alleging a breach of Rule 638(1)(d). Details are as follows:

‘in that C Dell permitted his mount SPECIAL SAKURA to shift outwards when not sufficiently clear of ALBAROSSA which was dictated outwards in the home straight’ 

Rule 638(1)(d) provides:

(1) A Rider shall not ride a horse in a manner which the Adjudicative Committee considers to be:

(d) careless.

The Respondent confirmed that he understood the Rule and admitted the breach.

Evidence:

Using available film, Stewards identified the incident and horses involved. Approximately 150 metres from the finish line, the Respondent’s mount was positioned some distance from the fence, with ALBAROSSA (Mr Marc Lerner) to her rear and outside. Mr Dell is then seen to allow his mount  to shift a number of horse widths, which in turn forces ALBAROSSA off his line. It is worthy of note, that as a result of the interference, an unsuccessful protest 2nd v 1st was lodged.  When asked, Mr Dell commented that his mount was having only her 2nd start, was very green and had reacted to having a horse to her outside. He added that she was on the ‘wrong’ leg and that when her action was corrected, she ran straight.

Decision:

As the Respondent admitted the breach, the Adjudicative Committee found the breach proved.

Submissions for Penalty:

The Respondent’s record remains clear, as it relates to any breach of this particular Rule within the 12 month reset period. Stewards noted that Mr Dell has had 290 rides over the last twelve months, noting that a significant period had been lost to injury.  It was contended that the carelessness sat mid-high range, with the Adjudicative Committee referred to the current NZTR Penalty Guide. Mr Dell asked that any suspension imposed, be deferred to enable him to satisfy riding commitments at Trentham on 21 December 2024.

Reasons for Penalty:

The incident is clearly identified through film. The Adjudicative Committee was satisfied that the degree of carelessness sat mid-range. The Respondent’s comments in respect to his mount, were noted. The current NZTR Penalty Guide provides a starting point for mid-range careless at a 7 day suspension. This was adopted as a starting point, with a 1 day reduction applied to reflect record.  A six day suspension was deemed appropriate. The Respondent’s request for deferment was granted.

Conclusion:

The Respondent’s Licence to ride in races is suspended for 6 National Riding Days, effective from the close of racing on 21 December 2024, up to and including racing on 30 December 2024.
