EVIDENCE:
Following the running of Race 3 an Information was presented by Mr Oatham alleging a breach of Rule 638(1)(d) by Rider, Brandon May in that he allowed his mount TAP’ N ‘GO to shift out when not clear of I’M A TIGER who was checked near the 200m.
Mr Oatham had Mr Davidson identify Mr May shifting out from behind horses and into the line of I’M A TIGER whose Rider, Kavish Chowdhoory, had to check.
Mr Davidson said Mr May was at best only a length and a quarter clear.
Mr May had nothing to add.
DECISION:
Mr May having admitted the breach the charge was deemed proved.
SUBMISSIONS FOR PENALTY:
Mr Oatham stated Mr May had two previous breaches on record.
17 September at Riccarton, low-range incurred a 6-day suspension.
25 February at Riccarton, low-range incurred a 5-day suspension.
Mr Oatham said the Stewards assess this breach as low-range adding that Mr Chowdhoory stated he was beaten well before the incident happened.
Mr May made no submissions and requested any proposed suspension to start immediately.
REASONS FOR PENALTY:
The Penalty Guidelines provide a 5-day suspension for a low-level breach of the Rule.
After viewing the replays, the Adjudicative Committee considered this breach to be clearly low-range and could see no reasons to depart from the Guidelines in this case.
CONCLUSION:
Jockey, Brandon May’s Licence to ride in races is suspended from the close of racing today 7 January 2023 up to and including racing on the 14 January 2023.
