Summary of Facts:

Film of the concluding stages of the race was shown and Stipendiary Steward Mr Coppins pointed out the 6 times prior to the 100 metre mark that Apprentice Jockey Lily Sutherland struck her mount. Miss Sutherland and Senior Jockey Kate Hercock who was present as her mentor, both confirmed his comments and had nothing to add.

Decision:

As the charge was admitted, it was deemed proved.

Submissions on Penalty:

Stipendiary Steward Mr Coppins informed the Adjudicative Committee that this was Miss Sutherland’s 3rd breach of this Rule. Her previous breaches had both resulted in a fine as per the Guidelines and he asked for a similar course of action to be followed with this charge.

Reason for Penalty:

As this was Miss Sutherland’s 3rd breach of this Rule, a fine of $500 was imposed as per the Guidelines.

It was pointed out to Miss Sutherland that any further breaches of this Rule by her would result in a period of suspension as stated in the Guidelines.

Conclusion:

Miss Sutherland is fined $500.
