FACTS

Mr McNeill, Rider of ‘HIT THE ROAD JACK’ admitted a breach of Careless Riding.

The carelessness being that near the 600m, he allowed his mount to shift outwards with ‘WAISAKE’ being checked (Information A17408).

Mr McNeill said that he understood the Rule, charge and confirmed to the Adjudicative Committee that he admitted the breach.

Film replays were shown with Mr Goodwin stating that Mr McNeill had been racing

3-back on the fence behind ‘MARGARET JEAN’.    He said that Mr McNeill’s mount

‘HIT THE ROAD JACK’ was hanging outwards a little approaching the 600m, however Mr McNeill let his mount shift out to go around ‘MARGARET JEAN’, which resulted in ‘WAISAKE’ being tightened and checked.

Mr McNeill said that his mount was hanging, but that he let it shift out a little too far.

DECISION

As the charge was admitted, it was deemed proved.

PENALTY SUBMISSIONS

Mr Goodwin said that Mr McNeill had a clear record under the Rule and placed the breach in the low-end.

Ms K Clapperton said that Mr McNeill had only been riding as an Apprentice Jockey for one month and that it was an error of judgment.

REASONS FOR PENALTY

The Adjudicative Committee took into account the degree of carelessness (low), the record and admittance of the breach and gave a one day discount from the starting point of 5-Riding Days Suspension.

CONCLUSION

As Mr McNeill was suspended up to 3 May on whip breaches, his Apprentice Jockey’s Licence was suspended from 4 May to 7 May inclusive (4-Days).  The days being: Riccarton, Otaki, Waikato, Awapuni.
