Evidence:
This was an adjourned hearing heard at Riccarton Park on 17 September 2022.
Following the running of Race 9, the Respondent, Class A Rider Opie Bosson, admitted a charge of failing to seek permission prior to leaving the course.
The Respondent acknowledged he understood the Rule and confirmed his admission of the breach.
Rule 606 provides:
Unless otherwise permitted by a Stipendiary Steward, once a Rider has presented himself in the jockeys’ room in accordance with Rule 605(1),  that Rider must remain in the jockeys’ room and other areas specified by the Stipendiary Stewards, until he has completed his riding engagements, when he shall seek the permission of Stipendiary Stewards to leave.
EVIDENCE:
Chief Stipendiary Steward, John Oatham, said that Mr Bosson had a ride in Race 9 where a whip charge was to be preferred following the race. When Stewards went to find Mr Bosson he had already left the course. On this occasion, the Respondent had failed to get permission to leave when there were outstanding matters affecting him.
The Respondent stated that his ride in Race 10 had been scratched and he just packed his gear and left for home, straight after Race 9.
DECISION:
The Respondent has admitted the breach which is therefore deemed proved.
SUBMISSIONS FOR PENALTY:
Mr Oatham said that historically breaches of this Rule had been dealt with by a fine of $100. He added that there had been a second breach where a Rider was fined $150. He submitted that a fine in the vicinity of $100 would be appropriate.
The Respondent elected to make no submission in regard to penalty.
REASONS FOR PENALTY:
This not a common breach. However, the Penalty Guide (2018) suggests a starting point of a $100 fine for a breach of the Rule. There being no particular aggravating or mitigating factors, and in addition this being Mr Bosson’s first offence of this Rule, the Adjudicative Committee determined that a $100 fine was the appropriate penalty in this case.
CONCLUSION:
Mr Bosson is fined $100.
